Copyright Termination

The U.S. Copyright Act permits authors and/or their heirs, under certain circumstances, to terminate the exclusive or nonexclusive grant of a transfer or license of an author’s copyright in a work or of any right under a copyright. For songwriters and recording artists, this means that they can terminate a grant of copyright in a work, such as a musical composition or a sound recording, that was previously granted to a third party, such as a publisher or a record label, provided specific requirements are met.

Sly Stone Sues former manager Jerry Goldstein for damages of $50 Million for converting or misappropriating Sly Stone's royalties.

January 28, 2010

LOS ANGELES – Legendary funk artist Sly Stone filed a lawsuit in Los Angeles Superior Court today on the eve of the Grammys charging his former manager Jerry Goldstein with fraud, breach of contract, breach of fiduciary duty, and conversion for diverting, converting and misappropriating his royalties and assets for over 20 years. The suit demands a full accounting from royalty collection companies to determine actual amounts taken but they are estimated to be in the $20-30 million range. The suit also seeks punitive damages.

Robert J. Allan to speak at Santa Monica Bar Association Trial Seminar

Robert J. Allan will be a panelist on the 2015 “Winning is the Only Option” Trial Seminar. Along with other panelists, David Ring, Nick Rowley and Michael Bidart, moderator David Olan will discuss how each attorney won their complex multimillion dollar cases. Additional speakers include Carl Douglas, Hon. Elizabeth Grimes, Lawrence Bohm and Edie Matthai.

Robert Allan was a member of Pacific Council Delegation to China, visiting with Ambassador Huntsman and senior Chinese government and private sector leaders.

At the invitation of US Ambassador Jon Huntsman Jr., a founding member of the Pacific Council’s Board of Directors, a 23-member delegation traveled to Beijing and Shanghai from April 4 to 8. In addition to meeting with the US Ambassador and his country team, the Pacific Council had meetings with senior Chinese policymakers, business leaders, and influential leaders in civic and cultural affairs. The delegation focused on China’s expanding role in global affairs, its rapid economic development, and the evolving Sino-US relationship. The delegation also explored China’s social and cultural evolution as it grows into a major economic, political, and military power.

Robert Allan of the USA China Law Group hosted the Pacific Council’s China delegation for a luncheon with several leaders representing Nanjing’s government and private sector, including: Qi Li, the Vice Major of Nanjing; Qiuyun Kong, the Director of the Nanjing Municipal Investment Promotion Commission; Ling Li, the Former Director of Nanjing Development and Reform Commission; Chunhua Guan, the CEO of Nanjing Textile Import/Export Corporation and the President and CEO of Laoshan Pharmaceuticals; Mei Xiao, the President of the Nanjing Business Investment Group; Yi Zhu, the General Manager and Director of the Guangzhou Bank; and Yumei Tao, the President of Nanjing Taoyumei Garment Design & Manufacturing company. Julia Zhu of the Allan Law Group was also in attendance.

Robert J. Allan speaks at the 2010 Directors’ College at Stanford Law School

Robert J. Allan was a panelist at the 2010 Directors’ College at Stanford Law School, an intensive program for directors and senior executives of publicly traded firms.

The event, which was held from June 20-22, 2010, examined issues related to corporate governance, strategy and compliance, including the board’s role in setting business strategy, executive compensation, techniques for controlling legal liability, the challenge posed by activist investors and changes in the rules governing the election of corporate directors.

Robert J. Allan speaks at the 15th Annual Director’s College at Stanford Law School

June 23, 2009

On June 23, 2009, Robert Allan spoke at the “Foreign Corrupt Practices Act” breakout session and the "globalization" session in the two day conference, which is the nation's premier executive education program for directors and senior executives of publicly traded firms. Mr. Allan is highly regarded in the area of international business, especially as it relates to U.S.-China relations. Other panelists included Alan Crain of Baker Hughes and the Hon. Stanley Sporkin, former U.S. District Court Judge. Attending the seminar are CEOs of publicly held companies, scholars and board members. Additional topics analyzed were the credit crunch, corporate governance and risk management.

On Tuesday, March 24, 2009, Robert J. Allan, Stella Yap, and Consultant Edythe Huang of the Allan Law Group met with co-counsel, Alan Dershowitz, Nat Dershowitz, and Amy Adelson to prepare for an oral argument to be presented by Alan Dershowitz in support of a brief filed by our firm and co-counsel for our client seeking the New York Appellate Court to overturn an arbitration award for over $90 million dollars which exceeded the arbitrator's authority and showed a manifest disregard for the law.

Mr. Allan outlined how non-performing loan transactions are affected by changing property markets in China, and how to evaluate opportunities and manage the risks in structuring asset investments in China.
